TERMS AND CONDITIONS

Overview

These Terms and Conditions apply when you browse or buy through the RL ART online store on rabatholaka.com. By placing an order, you agree to these terms together with the store’s Shipping, Returns and Privacy policies.

Supplier information

The RL ART online store is operated by Articulate Communications Pty (Ltd), a South African private company trading as RL ART. Website: rabatholaka.com. Email: info@rabatholaka.com.

1. Orders

When you place an order, you agree to provide accurate contact, billing and delivery information. Orders are subject to product availability, successful payment and the details shown at checkout. An order may be declined or cancelled where there is a genuine stock, pricing, payment or fulfilment issue. If I cannot fulfil an order after payment has been received, I will contact you and arrange a refund or other appropriate remedy in accordance with applicable law.

2. Prices and payment

Prices are shown in the currency displayed on the store and any delivery charges or other applicable costs are shown before you complete checkout. Payments are processed through the payment methods made available at checkout. I do not store your full card details.

3. Products and artwork

I take reasonable care to describe and present each product accurately. Colours and appearance may vary slightly between screens, print materials and physical artworks. Dimensions, editions, materials and other product-specific details are shown on the relevant product page where applicable. Purchasing an artwork or product does not transfer copyright or other intellectual-property rights.

4. Shipping and delivery

Processing times, delivery estimates, shipping charges and any available delivery options are set out on the Shipping page and at checkout. Delivery dates are estimates unless expressly agreed otherwise. If an order cannot be delivered within the agreed or legally required period, the remedies available under South African law will apply.

5. Returns, refunds and exchanges

Returns, refunds and exchanges are handled according to the Returns page and applicable South African consumer law. Where the cooling-off right under the Electronic Communications and Transactions Act applies to an online purchase of goods, you may cancel within 7 days after receiving the goods, subject to the Act and its exceptions. Custom-made or clearly personalised goods may be excluded from that cooling-off right where the law allows. Nothing in these terms removes rights you may have in relation to defective, unsafe or incorrectly supplied goods.

6. Customer accounts

If you create an account, you are responsible for keeping your login details secure and for keeping your account information accurate. You may manage your orders, addresses and account details through My Account where those functions are available.

7. Intellectual property

All artwork, illustrations, images, text, graphics, logos and other original content displayed through the store are owned by or licensed to RL ART unless stated otherwise. They may not be reproduced, copied, modified, distributed, sold, published or used commercially without prior written permission.

8. Privacy

Personal information collected through the store is handled in accordance with the Privacy Policy. The store may use service providers for payments, delivery, security, analytics and other functions needed to operate the store.

9. Website use and availability

You may not misuse the store, interfere with its security or operation, attempt unauthorised access, distribute malicious code, scrape personal information or use the website in a way that violates applicable law. I take reasonable care to keep the store available and accurate, but I cannot guarantee that it will always be uninterrupted or error-free.

10. Liability and consumer rights

To the extent permitted by law, I am not responsible for losses caused by events outside my reasonable control or by misuse of the website or products. Nothing in these Terms and Conditions excludes or limits any warranty, liability, remedy or consumer right that cannot lawfully be excluded under the Consumer Protection Act, Electronic Communications and Transactions Act or other applicable South African law.

11. Governing law

These Terms and Conditions are governed by the laws of the Republic of South Africa. Any dispute will be dealt with under applicable South African law and by a court or other forum with lawful jurisdiction, without limiting any consumer right to use an applicable complaints or dispute-resolution process.

12. Changes to these terms

I may update these Terms and Conditions when the store, its services or applicable requirements change. The version published on the store applies from the date it is updated, but changes do not remove rights that already apply to completed transactions.
